A BILL to amend and reenact section four, article nine, chapter sixty-four of the code of West Virginia, one thousand nine hundred thirty-one, as amended, relating to authorizing the auditor to promulgate a legislative rule relating to the transaction fee and rate structure.

Be it enacted by the Legislature of West Virginia:

That section four, article nine, chapter sixty-four of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended and reenacted to read as follows:

ARTICLE 9. AUTHORIZATION FOR MISCELLANEOUS AGENCIES AND BOARDS TO PROMULGATE LEGISLATIVE RULES.

§64-9-4. Auditor.
(a) The legislative rule filed in the state register on the tenth twenty-fourth day of August July, two thousand one, authorized under the authority of section ten-c, article three, chapter twelve, of this code, modified by the auditor to meet the objections of the legislative rule-making review committee and refiled in the state register on the twenty-sixth day of September, two thousand one, relating to the auditor (transaction fee and rate structure, 155 CSR 4), is authorized. with the following amendments:
On page 1, section 155-4-3, beginning on line 7 of subsection 155-4-3.2, following the word "transaction" and the period, by inserting the following: "The fee shall continue in effect until December 31, 2002."

(b) The legislative rule filed in the state register on the sixth day of August, one thousand nine hundred ninety-nine, under the authority of section two, article four-a, chapter twelve of this code, modified by the auditor to meet the objections of the legislative rule-making review committee and refiled in the state register on the eighth day of February, two thousand, relating to the department of administration and the auditor (state auditor's computer and technology donation program, 155 CSR 5), is authorized.

NOTE: The purpose of this bill is to authorize the Auditor to promulgate a legislative rule relating to the Transaction Fee and Rate Structure.
